The Directive (EU) 2024\/825 of the European Parliament and of the Council<\/a> introduces stricter rules on environmental advertising and sustainability communication within the European Union.<\/p>\n

From 27 September 2026<\/strong>, these requirements will become legally binding across the EU. The EmpCo Directive applies to companies of all sizes that communicate with consumers within the EU. Its aim is to prevent greenwashing and provide consumers with better protection against misleading environmental and sustainability claims.<\/p>\n

For companies, this may result in far-reaching changes \u2013 from packaging and websites to marketing materials and public communications.<\/p>\n

In this article, we focus on green claims<\/strong>, but the EmpCo Directive has a broader scope. In a future article, we will also look at the requirements introduced by the regulation regarding information on the durability and repairability of products<\/strong>. The new blacklisted practices, for example, include presenting a software update as necessary when it only adds functionality, advertising a non-repairable product as repairable, or encouraging consumers to replace consumables earlier than is technically necessary.<\/p>\n

Who does the Directive apply to?<\/h2>\n

The EmpCo Directive<\/a> applies to all companies<\/strong>, regardless of the number of employees or turnover, that communicate with consumers within the EU \u2013 whether in writing, verbally, at public events, digitally, or in print. This means that companies without a physical presence in the EU may also be affected if their communications are directed at customers living in an EU Member State.<\/p>\n

There is currently no transition period planned<\/strong>. For companies, this means that claims made across all communication materials must be revised by the 27 September 2026 deadline<\/strong>.<\/p>\n
